Phil Ineligible to Run for County Judge LIBERTY, August 26, 2010 - Liberty County Clerk Delia Sellers wrote to Paul Miles of the Election Division of the Secretary of State’s Office and asked, “Phil Fitzgerald our County Judge was a candidate on the ballot in the Primary Election and lost his race. He has now filed a Declaration of Write-In Candidacy for himself in the same race. Can you please send us the Law if he can or can not do this?” Paul Miles in his response to Sellers writes, “In the scenario you describe, the county judge is ineligible as a write in candidate for the office of County Judge in the 2010 General Election for state and county officers.
