Fitzgerald’s Actions Declared Void LIBERTY, March 20, 2009 – This morning Liberty County Court at Law Judge, Don Taylor signed and filed with the County Clerk’s Office an order declaring that the dismissal of 5 cases by Liberty County Judge Phil Fitzgerald to be void. The order explains that Liberty County Judge Phil Fitzgerald purported to the Judge of the Liberty County Court at Law and was the Presiding Judge of the court. According to the documents neither is true. The documents go on to say Judge Fitzgerald is not eligible to sit as judge of the statutory County Court. Any person assigned to sit as judge must meet the requirements set forth in the law and be assigned to this court by the Regional Administrative Judge. Judge Fitzgerald’s dismissal orders of the five cases in question are declared void and the cases will be placed back on the court’s docket. See related story... See Court Orders...
