Fitzgerald 0, Opponents 2 LIBERTY, October 11, 2009 – Embattled Liberty County Judge Phil Fitzgerald has lost two battles and the stage is set for a third in the 75th District Court of Judge C. T. “Rusty” Hight when the civil trial of Jessica Vickery VS. Phil Fitzgerald, NO. CV 0901654, starts early Monday morning. The first battle Fitzgerald lost was the dismissal of cases while he attempted to sit as the unqualified judge of the County Court at Law. Those dismissed cases were placed back on the courts docket and are currently being heard by visitng Judge Patrice McDonald.
The second battle Fitzgerald lost was with Allen Youngblood and i-dineout.com when Barbara Norwood, attorney for Fitzgerald, withdrew a subpoena ordering Youngblood to hand over confidential, protected information gained in the day to day course of journalistic work.
Several people have been called as witnesses in the case of Jessica Vickery VS. Phil Fitzgerald and will be in court early tomorrow, Monday, October 12, 2009. Fitzgerald is fighting to remain as the Trustee of Jessica Vickery’s Trust. Although many have speculated only Fitzgerald and his attorneys appear to know why.
